PAYMENT POLICY

Full payment is required to confirm reservations. For avoidance of doubt, full payment is required prior to check in.

If guests show up for check-in with more people than is specified in the confirmed booking, the following charges will apply:

1. If The Sticks is able to accommodate late add-on guests the following charges will apply:
   a)  additional charges incurred for changes in the booking (including increase in number of occupants in a room, change of rooms, additional meals, etc).
   b)  a penalty charge of RM300 for late notification
   NB: The maximum occupancy allowed in each room or Day Hut is as stated on the website. 
2. If there is insufficient capacity at The Sticks to accommodate the late add-on guests, the booking will be treated as a no-show and there will be no refund of charges.

CHANGES AND CANCELLATIONS

With notification at least 72 hours prior to arrival:

1. No administrative charges will apply for Changes and Postponements
   • all postponed visits must be completed within 9 months of the original travel date
   • additional booking fees may apply for new dates of visit falling on a weekend, public holiday or peak period
2. No charges for Cancellations
   • a voucher to the value of the booking, valid for 9 months from the original date, will be issued for all cancellation requests
   • where payments were made by card, the voucher value will not include gateway admin fees incurred with your booking.
   • where admin fees were previously incurred for booking changes, the voucher value will not include the value of such admin fees.

REFUNDABLE DAMAGE DEPOSIT

A Refundable Damage Deposit (RDD) is required with every booking.

Where credit card details were provided with the booking, the RDD will be held on that credit card over the duration of the visit. After which, the hold on the card will be released.

Where no credit card details are provided, the RDD must be remitted together with the booking fee to confirm the reservation. The RDD will be returned via bank transfer after the end of the visit.

For Overnight bookings, a RDD of RM200 per room is required. For Day Trips, a RDD of RM25 per person is required.

GENERAL WAIVER - LIMITATION OF LIABILITY

The Sticks reserves the right to modify the itinerary, to accept or retain any Guest as a participant in any activity at any time, or to withdraw the Guest if they deem it necessary for the comfort, convenience or safety of the other Guests.

Guests acknowledge that during their visit, Guests participate voluntarily in activities arranged by The Sticks, and insofar as legally permissible, surrender their right to any cause of action against The Sticks arising from any loss or damage to person or property that occurs during their participation in activities organised by The Sticks.

Guests hereby agree to be responsible for their own welfare and accept any and all risks of delay, unanticipated events, inconvenience, illness, injury, emotional trauma or death.

Guests hereby certify that they are physically fit and have not been advised to not participate, by any means or in any manner, in any such activity arranged by The Sticks by a qualified medical professional.

Guests hereby certify that there are no health-related reasons or problems which preclude their participation in any and all activities arranged by The Sticks, should they decide to participate.

Guests hereby waive, release and discharge from and against any and all liability from their participation in activities at The Sticks, including but not limited to, liability arising from the negligence or fault of The Sticks and/or its employees and/or its collaborators and/or its subcontractors, for a participants death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to a participant from activities arranged.

Guests agree that this release shall be legally binding upon Guests personally and all members of their family.

GENERAL DISCLAIMERS

All reservations and bookings are processed on a first come first served basis.

Travel insurance is NOT included in the price of the booking, and recommended for ultimate protection.

RESERVATION OF RIGHTS

Guests shall not use the property except for permitted use and shall not use the property for any offensive, noisy, dangerous, illegal, entertainment, immoral or improper purposes. Guests shall not do anything which may be a nuisance or annoyance to The Sticks and its guests, staff or owners.

Guests shall keep all The Sticks fixtures, fittings, furniture and effects in a clean and good condition and shall replace any articles which are destroyed or missing with articles of a similar kind and of equal value. The Sticks reserves the right to deduct charges incurred for damages identified at management's discretion from the Refundable Damage Deposit.

The Sticks reserves the right at its sole discretion to terminate use of the property or any of its facilities by Guests in the event of any breach of these terms and conditions. Guests will be required to vacate the property and The Sticks shall not refund payment or accept any consequential liability damages or loss.

The Sticks reserves the right to alter any facility or accommodation.

PHOTO/VIDEO RELEASE FORM

Guests hereby grant The Sticks the right and permission to use photographic material & video in which they are featured and are taken during the course of their visit. The Sticks holds the right to use / republish / copyright, etc. this material for advertising and promotional purposes.

Guests hereby release and discharge The Sticks from any and all claims and demands arising out of or in connection with the use of the photographs and video footage, including without limitation any and all claims for libel or invasion of privacy.

Where reservations are made on behalf of other parties, the person making the reservation hereby confirms that he/she is authorised to accept these terms and conditions on behalf of the other persons in the reservation.

The Sticks reserves the right to change or amend this policy at any time. The current policy is always applicable.

By booking a visit to The Sticks you hereby certify that you have read and fully understood the present Terms & Conditions, and you are fully aware that there is a release of liability included, you accept all Terms & Conditions and you agree of your own free will to all Terms & Conditions and applicable policies above.
